The Ministry of Food and Drug Safety introduced the Adverse Drug Reaction Relief System at the "2026 Scientific Conference of the Korean Academy of Medical Sciences" on the 12th, under the theme "Adverse Drug Reactions and Relief: The Role of Medical Practice in Completing Patient Safety."
During the session, clinical specialists and legal experts gave presentations and took part in a panel discussion on topics including adverse drug reactions and relief cases seen through clinical examples, the current state and future of the Adverse Drug Reaction Relief System from the perspective of medical experts, and the value of the system and the role of medical staff from a legal standpoint.
The Adverse Drug Reaction Relief System is a state compensation program for serious, unexpected harm caused by adverse reactions, such as death, disability, or illness, even when a medicine has been used properly. It has been in effect since December 2014. The ministry has gradually expanded the scope of compensation from death benefits to disability benefits and medical expenses, including both covered and non-covered treatment costs. By last year, it had paid a total of 1,266 cases, amounting to about 19.6 billion won.
Medical expenses, including out-of-pocket and non-covered costs, are eligible for compensation, and applications can be filed when inpatient treatment costs exceed 300,000 won. However, cases involving non-prescription or non-over-the-counter medicines, as well as investigational drugs, may be excluded. National immunization, medical accidents, intentional acts or gross negligence, and cases already compensated under other laws are also excluded.
